Exclusion of evidence from a narcotics case
The police had obtained a search warrant to search our client's home, where various narcotics had been seized. During the trial, we asked the judge to quash the search warrant and exclude all of the evidence gathered since it had been obtained in violation of our client's constitutional rights. Case Settlement - First degree murder for manslaughter
At his first trial, our client was charged and later found guilty of first degree murder in a case dating back to the late 1980s. Our firm obtained an order for a new trial before the Quebec Court of Appeal. . In preparation for the second trial, the defense made several preliminary motions, and succeeded in having the client's confessions taken during a "mister big" operation excluded. The prosecution later offered the client to enter a guilty plea to a reduced offense of manslaughter. Due to time spent in pre-trial detention, the client was released from jail the same day the client's confession was ruled out, after entering a guilty plea to a reduced count of manslaughter. Intervention before the Supreme Court of Canada
Me Maxime Raymond represented the interests of the Quebec Association of Lawyers and Defense Lawyers (Aqaad) before the Supreme Court of Canada in the Sharma case. This case dealt with the availability of conditional sentencing (house imprisonment) for certain criminal offenses and the constitutionality of certain provisions of the criminal code. Mr. Raymond's representations on behalf of the aqaad were aimed at increasing the number of offenses where a conditional sentence is an available sentence.
